1. Acceptance of Terms

By accessing or using OpenParking ("the Service"), operated by 5280 Parking, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

OpenParking is a parking permit management platform that allows property operators to sell and manage parking permits online, and allows customers to purchase permits and verify their identity via phone number.

3. User Accounts and Eligibility

You must be at least 18 years of age to use this Service as an operator.
You are responsible for maintaining the security of your account credentials.
You agree to provide accurate and current information when registering.
You are responsible for all activity that occurs under your account.

4. SMS Terms

By providing your phone number on the OpenParking platform, you agree to receive SMS messages from OpenParking including:

One-time verification codes (OTPs) — single messages sent when you request access to a parking permit
Permit reminders — notifications about upcoming permit expirations (if enabled by your operator)

Message frequency: Verification messages are sent on-demand when you request them. Reminder messages vary by operator configuration.

Message and data rates may apply. Check with your mobile carrier for details.

To opt out: Reply STOP to any SMS message to unsubscribe. You will receive a confirmation message and no further messages will be sent.

Opting out of SMS messages may prevent you from completing phone verification required to access your parking permit.

5. Payments and Refunds

All payments are processed securely through Stripe.
Permit fees are set by individual operators, not by OpenParking.
Refund policies are determined by the individual parking operator.
OpenParking charges a platform fee per permit as described on the pricing page.

6. Operator Responsibilities

As an operator using OpenParking, you agree to:

Provide accurate location and permit information
Honor permits sold through the platform
Comply with all applicable laws regarding parking, towing, and consumer protection
Not use the platform to sell permits for locations you do not own or manage
Connect a valid Stripe account for payment processing

7. Prohibited Uses

You may not use OpenParking to:

Violate any applicable law or regulation
Submit false or fraudulent information
Interfere with or disrupt the platform or its servers
Attempt to gain unauthorized access to any part of the Service
Use the Service for any commercial purpose not expressly permitted

8. Intellectual Property

All content, features, and functionality of OpenParking — including but not limited to the software, design, text, and graphics — are owned by 5280 Parking and are protected by applicable intellectual property laws.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, 5280 Parking shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may cancel your account at any time by contacting us.

12. Governing Law

These Terms shall be governed by the laws of the State of Colorado, without regard to its conflict of law provisions.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
